4/ 7.9.12. Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
Learned counsel appearing for the petitioner submitted that this is third occasion when the petitioner has been moving for grant of bail as at earlier two occasion, prayer for bail of the petitioner had been rejected by this Court.
It was further submitted that while rejecting the prayer for bail on 23.12.2011, liberty was given to the petitioner to renew the prayer for bail, if the trial is not concluded within four months but the situation is the same as it was there on 23.12.2011 as still neither the Doctor nor the Investigating Officer has been examined and moreover, similarly situated co-accused, namely, Mahendra Singh Kharwar against whom there is similar allegation as that of this petitioner has been admitted to bail by this Court, vide B.A. No.3157of 2012.
Regard being had to the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Garhwa in S.T.No.145 of 2009 arising out of Bhandaria P.S. Case no.37of 2007.
