05/07.09.2012 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.

Learned counsel appearing for the petitioner submits that earlier prayer for bail of this petitioner was rejected on 24.01.2011 but since then there has not been any progress as a result of which the trial in which the petitioner has been in custody since 28.01.2010 is not likely to be concluded at the earliest. It was further submitted that earlier a report was called for from the court concerned with respect to expected time to be consumed in conclusion of the trial. In response thereto, the court submitted a report perhaps in the month of April, 2012 whereby it has been reported that only the doctor and I.O. are to be examined within two or three months. In that situation, this case was ordered to be listed after three months but still those two witnesses have not been examined and under the situation, the petitioner deserves to be admitted on bail.

Regard being had to the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, 1st, Garhwa, in connection with Garhwa P.S. Case No. 334 of 2009, corresponding to G.R. No. 1438 of 2009, S.T. No. 93/2010, subject to condition that the petitioner shall present on each and every date of trial.
