The petitioner is an accused in a case instituted under Section
395 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner was rejected, taking into account the submission advanced on behalf of the State that three persons have named this petitioner, as the person, who along with others, committed offence of dacoity, but no such statement of the witnesses is there rather the witnesses have simply stated that this petitioner was seen along with others near the place of the occurrence, which never go to suggest that the petitioner had committed dacoity in the house of the informant.
Regard being had to the facts and circumstances of the case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Assistant Sessions Judge, III, Dhanbad in S.T. No.115 of 2010.
