Instant application filed by applicant/appellant is for condonation of delay in re-admission of appeal, dismissed for non-prosecution on 01.07.2022, on the ground that the counsel for appellant was suffering from Vertigo for a long time and due to this ailment he could not attend the case in the year 2021. This application is supported by an affidavit duly sworn by the advocate.
On perusal of application and after hearing learned counsel for parties, I find a sufficient cause is shown by applicant for condoning delay. Accordingly, this application is allowed and delay in filing the appeal is condoned and appeal is re-admitted to its original number.
List the appeal on 25.03.2025.
