Through the medium of present petition, the petitioner has challenged charge sheet arising out of FIR No. 27/2023 for offences under Sections 409, 420 and 109 IPC registered with Police Station, Pulwama which is stated to be pending before the court of learned Chief Judicial Magistrate, Pulwama.

It is contended that there is a delay in lodging the FIR and that there is nothing on record to suggest involvement of the petitioner in the alleged crime. All the aforesaid contentions can very well be projected by the petitioner at the time of framing of charges before the learned trial court as the charges are yet to be framed in the case.

The petition is accordingly disposed of giving liberty to the petitioner to raise the grounds which have been raised in the petition before the learned trial court at the time of framing of charges and in case, the petitioner feels aggrieved of the order that may be passed by the learned trial Magistrate, he shall be at liberty to approach this Court afresh.
