01. Mr. Anishwar Chatterji Koul, learned counsel submits that the present petition is rendered infructuous on account of the fact that the appeal “ Pharose Remedies Vs. Vijay Kumar & Ors. ” before the court of Additional District Judge, Samba out of which the present proceedings came to originate has been disposed of and, therefore, the base of the lis sustaining this petition is no more and, therefore, the petition is to be dismissed as infructuous. Plea is genuine, as such, the present petition is dismissed as rendered infructuous.
02. In case, the petitioner would reckon that the lis was surviving for this Court to adjudicate upon, then the petitioner would have the liberty of coming to this Court for seeking revival provided the same is done within a period of 30 days from the date of passing of this order.
