Petitioners allege that their land was notified to be acquired under notification dated 19.03.2019, issued under Section 4 of the Jammu and Kashmir Land Acquisition Act but thereafter nothing has happened as neither any declaration under Section 6 has been issued nor any award has been made but still respondents are trying to take the possession of the land.

The notification under Section 4 of the Land Acquisition Act is simply a proposal to acquire the land but no further proceedings thereafter has been initiated, it is therefore, clear that the land has not been acquired as on date. We do not find any material which may

indicate that respondents are trying to take possession of the land so notified to be acquired.

In view of the aforesaid facts and circumstances, we dispose of this writ petition with the direction to the respondents not to proceed to take possession of the land without following the due procedure, prescribed in law. Disposed of.
