The grievance projected by the Petitioner, in the instant Petition,

is that as and when he participates in the tendering process issued by the Respondents, the Respondent No.2-Mr Mustafa Majid, Convenor, Canteen Committee, Government Degree College, Ganderbal, whom he has arrayed as a party Respondent in person, always rejects the bid of the Petitioner on arbitrary and mala fide grounds.

In terms of Order dated 13^th of August, 2021, the Court directed Mr Asif Maqbool, the learned Deputy Advocate General, representing the Respondents, to get instructions in the matter with regard to the averments made by the Petitioner in the Petition.

Today, when the matter was taken up for consideration, Mr Asif Maqbool, the learned Deputy Advocate General, on instructions, submitted that there is no mala fide intention on part of the Respondent No.2 towards the Petitioner and that the averments made by the Petitioner are only based on mere apprehension.

Without going into the merits of the case and with the consensus of the learned counsel for the parties, it is thought just and proper to dispose of this Petition with a direction to the Director, Colleges, J&K Higher Education Department to treat the instant Petition as representation on behalf of the Petitioner, consider the claim made therein by the Petitioner and pass appropriate orders thereon in accordance with the law and the rules governing the field before the tendering process in question is taken to its logical conclusion. Ordered accordingly. Let consideration be affected and decision taken expeditiously, as aforesaid, preferably within six weeks from today. Petitioner may, on his part, handover copy of the entire paper book in the office of Director, Colleges, J&K Higher Education Department, along with a copy of this Order, so as to ensure an early decision in the matter.
