impugned in the revision was passed by the Executive Magistrate 1st Class (Assistant Commissioner), when the subject matter i.e. land measuring 42 kanals and 9 marlas was situated in the district of Anantnag and any order passed by any Judicial Magistrate or Executive Magistrate in the district was subject to the revisional jurisdiction of the learned Sessions Judge, Anantnag. However, with the creation of Kulgam as a separate district in the year 2008, the area where the subject matter is situated came to be excluded from the district of Anantnag and became part of Kulgam district. The order passed by the Executive Magistrate 1st Class (Assistant Commissioner), Anantnag, which is subject matter of challenge in the revision, in these circumstances, shall be deemed to have been passed by the successor of the Assistant Commissioner(Executive Magistrate 1st Class), Anatnag, who now exercises such powers in relation to the area where subject matter of revision petition is situated. The Principal Sessions Judge, Anantnag, too, has ceased to have jurisdiction over the area, which is now part of district Kulgam. It is, thus, the Principal Sessions Judge, Kulgam, who would succeed the Principal Sessions Judge, Anantnag in the matter of considering the revision petition.
