Bail petitioner namely Deepak, who is behind bars since 03.05.2026, has approached this Court in the instant proceedings for grant of regular bail in case FIR No.59/26 dated 02.05.2026, under Sections 20, 25 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Baijnath, District Kangra, Himachal Pradesh. 2. Pursuant to directions issued by this Court, respondent-State has filed status report, perusal whereof reveals that commercial quantity of contraband was recovered from the

conscious possession of the petitioner. Since no plausible explanation ever came to be rendered on record qua possession of aforesaid commercial quantity of contraband, Police after having completed necessary codal formalities lodged FIR and since then, he is behind bars.

Through instant petition prayer came to be made on behalf of the petitioner that since petitioner has to appear in examinations, commencing from 03.07.2026, he may be enlarged on interim bail for a period of 15 days. This Court with a view to ascertain factum of examinations, if any, to be written by petitioner, directed Investigating Officer to confirm from the college concerned whether petitioner is eligible to write examinations or not?

Pursuant to afore directions, Investigating Officer received information from DDM Sai Law College, Hamirpur, where at present petitioner is studying in the fourth semester. Vide communication dated 02.07.2026, College concerned has clarified that though petitioner is a student of LL.B 4^th Semester, but on account of short attendance and absence from final Moot Court, practical viva and written assessment tests, he is not eligible to sit in examinations.

Having perused aforesaid communication, copy whereof has been handed over to learned counsel representing the petitioner, learned counsel representing the petitioner seeks permission to withdraw the present petition with liberty to file

afresh, at appropriate stage, if require and desired. Ordered
