This arbitration case has been filed under Section 29A(4) & (5) of the Arbitration and Conciliation Act for extending the period for passing of the award by the learned Arbitrator.

Learned Arbitrator was appointed pursuant to the order passed on 28.12.2018 in CWP No.2740 of 2018. Learned Arbitrator could not decide the claim preferred by the claimant within the stipulated period. As such, vide order dated 24.02.2023 proceedings were closed by him.

Petitioner seeks extension of time for completion

of the arbitration proceedings. Learned counsel for the petitioner submitted that petitioner had been suffering from various ailments and he had remained under treatment for more than six months. Hence, he could not move earlier in time for seeking extension of the period for passing the award under the Arbitration and Conciliation Act.

4. Heard, learned counsel on both sides.

Taking into consideration the pleadings and submissions made on behalf of the parties, the period for completion of arbitration proceedings by the learned Arbitrator in case under reference, is extended by six months, to be reckoned from today. The parties through their learned counsel are directed to appear before the learned Arbitrator on 26.07.2024.

Pending miscellaneous application(s), if any, also stand disposed of.
