The appeal has been dismissed vide separate judgment of the even date. After pronouncement of the judgment, learned counsel for the plaintiff/appellant informs the Court that pursuant to the judgment and decree rendered by the learned Trial Court, the plaintiff/appellant had deposited a sum of Rs. 3,07,000/- before the Court, which now in view of the dismissal of the appeal to be refunded to his client. Learned counsel for the respondent/defendant has no objection to the same.
Accordingly, the learned Trial Court is directed to refund/release the amount deposited by the plaintiff/appellant alongwith upto date interest by remitting the same to the bank account of the plaintiff/appellant, details of which shall supply by the learned counsel for the plaintiff/appellant within four weeks.
