On 21.12.2022, this Court had passed an order in

CMP No. 16507 of 2022 and applicants, as detailed in para-2 of the application, were ordered to be substituted as respondents No. 1(i) to 1(v) in RFA No. 314 of 2010. Registry was directed to carry necessary amendments in the cause title. The needful has been done.

Learned counsel for the applicants has pointed out that this Court had finally disposed of CMP No. 16507 of 2022 without passing any orders on the prayer of the applicant for release of deposited amount. Record reveals that the contention so raised has substance. This Court in exercise of powers vested under Section 151 of Code of Civil Procedure, deems it fit to modify order dated 21.12.2022 in CMP No. 16507 of 2022 and allow prayer of deceased respondents No. 1(a) to 1 (e) for release of amount lying in deposit in the Registry of this Court. Record reveals that a sum of Rs. 3,40,690/- is lying in deposit with the Registry of this Court. The amount, so lying in deposit, be

released in favour of the respondents No. 1 (a) to 1(e) alongwith up to date interest accrued thereon till date in equal shares by remitting the said amount in the bank accounts of the applicants, details of which have been provided, vide Annexures A-3 to A-7, annexed with the application, after due verification.
