This petition coming on for orders this day, the Court passed the following:

ORDER

By way of present petition, petitioner has prayed for the following substantive relief:

“1. That the respondents may kindly be directed to extend the benefits of PTA Grant in Aid rules 2006 to the petitioner without any discrimination, from the date of initial appointment.

That the instant writ petition may kindly be allowed and the respondents may kindly be directed to extend the benefit of Grant-in-Aid in favour of the present petitioner at par with the similarly situated persons with all consequential benefits and take a decision in the light of judgment passed by this Court in CWP No. 2549/2015, titled Hem Raj Sharma vs. State of HP and CWP No.2638/2015, titled Devi Saran vs. State of H.P. (Annexures P-5 and P-6)”

Though reply on behalf of respondents-State as well as

rejoinder thereto, stand filed, but before the case at hand could be heard and decided on its own merit, learned counsel for the petitioner stated that the petitioner would be content and satisfied in case the respondents are directed to consider and decide the case of the petitioner in light of judgment dated 26.03.2018,5 passed by Division Bench of this Court in CWP No. 2314 of 2017, titled Manjit Singh v. State of H.P.

Learned Additional Advocate General is not averse to the aforesaid innocuous prayer made on behalf of the petitioner. Otherwise also, careful perusal of judgment dated 26.03.2018, passed by Division Bench of this Court in Manjit Singh’s case supra, clearly reveals that issue raised in the petition at hand already stands adjudicated and as such, there appears to be no impediment in accepting the prayer made on behalf of the petitioner.

Consequently in view of above, present petition is disposed of with a direction to the respondents to consider and decide the case of the petitioner in light of aforesaid judgment in Manjit Singh’s case (supra), expeditiously preferably within a period of six weeks from today. In case petitioner is found similarly situate to that of the petitioner in Manjit’s Case supra, similar benefits shall also be extended to him. Needless to say, authority concerned while doing the needful in terms of the instant order, shall afford opportunity of hearing to the petitioner and pass speaking order thereupon. Petitioner shall be at liberty to file appropriate proceedings before appropriate court of law, in case, he still remains aggrieved.

Petition stands disposed of in the above terms, so also the pending application(s), if any.
