as CW-1 tendered his evidence by way of affidavit, Ext. CA, wherein he reiterated the case as set up in the complaint. He also tendered in evidence, cheque Ext. CB, return memo, Ext. CC, return memo, Ext. CD, legal notice, Ext. CE, postal receipt, Ext. CF and acknowledgement, Ext. CG. Cross-examination conducted upon this witness nowhere suggests that the accused was able to extract anything contrary to what this witness stated in his examination-inchief. In cross-examination, this witness admitted that he was known to accused for 10-12 years. He admitted that he had paid Rs.1.00 lakh on 15.1.2013 at his house at Kullu. He further admitted that when the accused borrowed amount from him, except accused, none was present. He admitted that no writing was prepared qua said transaction. He further stated that cash was lying with him in his house and at the time of borrowing said amount, accused had assured to repay the same within two months. He further admitted that at time of making payment, accused had not issued any cheque and cheque was issued on 8.3.2013. He stated that accused had filled in cheque and handed over to him at his house at Kullu. He admitted that cheque was filled up in English except signatures, which were in Hindi. He denied that accused had borrowed Rs. 25,000/0- from him and had issued blank signed cheque as security to him. He also denied that the alleged borrowed amount of Rs. 25,000/- was returned to him by the accused and cheque remained with him in good faith.
