The present application under Section
378(4) of the Code of Criminal Procedure, has been maintained by the applicant, for grant of leave to appeal. As per the applicant, he has a good prima facie case in his favour and there are every possibility of the appeal being accepted, as such, the present application may be allowed and leave to appeal may be granted against the impugned judgment of acquittal. The application is duly supported with an affidavit.
Heard. Taking into consideration the fact that the applicant has an arguable case and there are certain points involved in the appeal which need consideration. In view of this, the present application for leave to appeal is allowed and is accordingly disposed of.

Respondent to furnish personal bonds in the
sum of Rs. 10,000/- with one surety in the like amount, to the satisfaction of learned trial Court, within a period of six weeks, undertaking therein to appear in the Court as and when required and to surrender before the Court if ultimately the appeal is allowed.
