The present application is maintained by the applicant-State under section 378(3) Cr.P.C. for grant of leave to appeal against the judgment of acquittal dated 15.05.2019 passed by the learned Sessions Judge, Kangra at Dharamshala, H.P. in Criminal Appeal No.33K/X/2014/2016, under Sections 279, 338 and 304-A of IPC, whereby the judgment/order of conviction and sentence dated 25.6.2014 passed by the learned Judicial Magistrate 1^st Class (II) Kangra in Criminal Case No.97II/2016 has been set aside.

As there are sufficient arguable points in the appeal, leave to appeal is granted. The application stands disposed of.

The respondent-accused shall furnish personal

bond to the sum of Rs.25000/- with one surety of the like amount to the satisfaction of the trial court, undertaking therein that he will appear before the court as and when required and will surrender before the court to undergo sentence, in case the appeal is allowed.
