The present application is maintained by the

applicant, under Section 378 (3) of the Code of Criminal Procedure for granting leave to appeal.

Learned Deputy Advocate General has argued that the bare perusal of the judgment passed by the learned Court below shows that there are certain arguable points in the appeal which required consideration. On the other hand, learned counsel for the non-applicant/respondents has argued that the prosecution has failed to prove the guilt of the accused beyond the shadow of reasonable doubt and there is no ground for allowing leave to appeal.

Heard. This Court after hearing the learned

counsel for the parties and gone through the record, finds that the applicant has an arguable case and there are certain points involved in the appeal which need consideration. In view of this, the present application is allowed and is accordingly disposed of.

Respondents to furnish personal bond to the tune of ` 20,000/- each, with one surety in the like amount each to the satisfaction of learned trial Court, within a period of eight weeks, undertaking therein to appear in this Court as and when directed and in the event of allowing the appeal, the respondents will surrender before the Court

to undergo sentence, if any, imposed by this Court.
