It is not in dispute that the order passed by the Financial Commissioner (Appeals), on 18.01.2002, which has been assailed in the instant writ petition, is already a subject matter of Review Petition No.

5/2002 pending adjudication before the Financial Commissioner (Appeals) and therefore the instant petition is clearly pre-mature and not maintainable at this stage.

Accordingly, the same is disposed of with the direction to Financial Commissioner (Appeals) to decide the review petition as expeditiously as possible and in no event later than 31.03.2018.

It goes without saying that in the event of the order going against the petitioner, he shall be entitled to assail not only the final order but also those orders which form subject matter of the instant lis.

The Registry is directed to remit the records to the concerned quarter forthwith.

Parties to appear before the Financial Commissioner

(Appeal) on 27.12.2017 at 2:00 p.m.
