under Section 151 of the Code of Civil Procedure, for releasing of the compensation amount lying deposited before this Court. As per the applicant, respondent No.1/appellant, who was working as goldsmith met with an accident on 27.8.2006, because of which, both legs were got fractured. After the occurrence of accident, he was taken to Kangra Government Hospital, thereafter to Dharamshala Hospital and then he was referred to PGI, Chandigarh. He was suffered disability to the extent of 45% permanent in nature. Now, he has become helpless disabled person, unable to do his own course of daily life himself without the help of any other person. The learned Tribunal below, awarded a sum of `7,43,425/- with interest @ 9% per annum w.e.f. 21.8.2007 from the date of filing the petition in favour of the applicant. As per the applicant, he is still getting regular check up and treatment from PGI, Chandigarh. He has spent a huge amount on transportation and medical expenses approximately about rupees five lacs. The application is duly supported with an affidavit. Reply to the application has been filed and it is averred that there is no proof that the applicant is under treatment and as the appeal is likely to be allowed in all probability, the amount may not be released to the applicant.
