Proposed legal representatives of sole respondent Kanshi Ram are duly served, however, failed to put in appearance. Deceased Kanshi Ram was petitioner and complainant in LAC petition No. 19/15 (2009). He expired during the pendency of the reference petition before learned reference Court below on 18.10.2009. True it is that the consequential steps were not taken during the pendency of the reference petition and the same was disposed of with a bunch of petitions, lead case whereof was LAC Petition No.9/14 (2009), titled Tara Chand versus LAC. The reference petition filed by deceased Kanshi Ram has been decided in a bunch on appreciation of the evidence, which was recorded in the lead case. Being so, there is no question of abatement of the proceedings in the reference petition as the similarly situated persons were there to pursue the reference petitions, which were decided vide common award, on the basis of the common evidence recorded in lead case referred to hereinabove, therefore, in view of the judgment of this Court in Collector Land Acquisition NHPC versus Khewa Ram & Others, Latest HLJ 2007 (HP), 270 , there is no question of abatement of the proceedings.
