The learned counsel appearing for the petitioner seeks permission of this Court to withdraw the instant petition. Permission granted. The instant petition is dismissed as withdrawn being premature. However, liberty reserved to the petitioner herein to concert by resorting to the alternative mode, the apt, germane and relevant evidence before the learned trial Court in disproof of the paternity or of his being the father of Ms. Dipika. In the event of his not succeeding in that endeavour, then, he may re-apply to the learned trial Court for conducting the DNA test to de-establish his being the father of Ms. Dipika. on the application as may come to be instituted at his instance before the learned trial Court for the purpose aforesaid is rendered, then it will be open to the petitioner herein to move this Court afresh. All pending applications also stand disposed of.
