Rule . Learned AGP waives service of notice of rule for the respondent-State.

When the matter is taken up for hearing, learned AGP has forwarded a communication dated 28.06.2022 written by the Sub Registrar, Pardi withdrawing the impugned communication dated 14.12.2021. He has submitted that appropriate action will be taken once the appropriate entry made by Mamlatdar, e-dhara kendra, Pardi and accordingly, the documents will be released.

It is clarified that the Court in the judgment dated 25.02.2021 passed in Special Civil Application No.3529 of 2016 has already settled the issue with regard to provisions under Section 73AA of the Bombay Land Revenue Code, 1879, hence such issue shall not be raised.

It is also not in dispute that the document no.1428 is already registered as per the receipt produced at page no.30 of the writ petition, which is not denied by the respondent.

Under these circumstances, the respondents are directed to do the needful as per the judgment of this Court dated 25.02.2021 passed in Special Civil Application No.3529 of 2016 and accordingly, after completion of formalities, shall release the documents forthwith and supply to the petitioner.

The entire exercise shall be completed within a period of four weeks from the date of receipt of the writ of this order.

With the aforesaid directions, the present petition stands disposed of. Rule is made absolute.
