Heard learned advocate Mr.P.M. Dave for the petitioner, learned advocate Mr.Pranav Desai for the respondent No.1 and learned advocate Mr.Bhavesh Chokshi for the respondent No.2.

Learned advocate Mr.Dave for the petitioner submitted that this petition was filed when the Presiding Officer of the Debt Recovery Tribunal (for short “the DRT”) was not available. It was submitted that now, the charge of the Presiding Officer is handed over to the Presiding Officer of the DRT-II vide notification dated 2^nd February, 2022. In such circumstances, the petitioner would approach the DRT-II for early hearing of the Securitisation Application No.110 of 2019 as expeditiously as possible as the petitioner is without the possession of the

property purchased in auction sale for which registered sale-deed is also executed by the respondent Bank in favour of the petitioner in the year 2019.

Mr.Dave submitted that the petitioner shall make an application before the DRT-II within a period of two weeks for early hearing of the SA No.110 of 2019.

The Tribunal is directed to consider such application as expeditiously as possible considering the grievance raised by the petitioner in this petition.

With the aforesaid direction, the petition is disposed of. Notice is discharged.
