Mr. Chauhan, learned advocate for the
applicant, relying upon the decision in the
case of Rohitbhai Jivanlal Patel Vs. State of
Gujarat & Anr., reported in (2019) 18 SCC
106, submits that there is no dispute
regarding the signature and inspite of that,
learned Trial Court Judge has laid down all
the burden on the complainant and had doubted
the case of the complainant on the ground of
financial capacity by placing unnecessary
burden on the complainant which is a
fundamental flaw.
