Learned advocate Mr. N.K.Majmudar states at bar that he has instructions to appear for respondent nos.4 and 5, who happen to be father and uncle of Corpus – Ms. Asmitaben.

By way of present petition, the petitioner who happens to be husband of the Corpus has filed present petition to produce Corpus – Ms. Asmitaben and to release her from illegal detention and confinement of respondent nos.4 and 5 and to hand over the custody of the Corpus – Ms. Asmitaben to the petitioner forthwith.

The Corpus – Ms. Asmitaben is produced by respondent no.4 and 5 before us. We have interacted with the Corpus in presence of the petitioner and learned advocate Mr. M.V.Patel for the petitioner and also learned advocate Mr. N.K.Majmudar

for respondent nos.4 and 5. The Corpus has categorically disclosed that she is not in illegal confinement of respondent nos.4 and 5 and she has voluntarily abandoned her matrimonial home and she does not want to stay with the petitioner. She has also disclosed before us that she is not in illegal custody of respondent nos.4 and 5 or forcibly detained by them.

In light of above, we do not find any substance in the present petition and therefore, present petition stands disposed of. Notice is discharged.
