Heard Mr. H. N. Bhrambhatt, learned advocate for the petitioners, Ms. Nidhi Vyas, learned AGP for respondent no.2, Mr. Niral Mehta, learned advocate for respondent no.1 and Mr. Deep D. Vyas, learned advocate for respondent no.3.

Mr. H. N. Bhrambhatt, learned advocate for the petitioners seeks permission to withdraw the petition with a view to make a representation to the authority competent as per the provisions of the Gujarat Town Planning and Urban Development Act, 1976 (For short “the TP Act”). He submits that competent authority may be directed to decide a representation within some time bound schedule.

In view of the aforesaid request made by Mr. H. N. Bhrambhatt, learned advocate, permission, as prayed for, is

granted.

As and when a representation is made by the petitioners, the competent authority as per the provisions of the TP Act is directed to decide such representation strictly in accordance with law as early as possible preferably within a period of six months from the date of receipt of such representation.

It is made clear that this Court has not gone into the merits of the matter. Hence, the competent authority may not get influenced by the fact that this petition is withdrawn by the petitioners.

Present petition stands disposed of as withdrawn.
