This petition under Article 226 of the Constitution of India is filed for the purpose of seeking correction in the date of birth as well in the surname of the petitioner.

When the matter is taken up for hearing, learned advocate Mr. Savani has candidly submitted that for the purpose of this request, before approaching the Court, specific application was given to the competent authority, which is reflecting on page 10 of the petition compilation, and the same is received by the Talaticum-Mantri of the village on 7.10.2020. But, so far, no decision is taken thereon and as such, Mr. Savani has requested that some suitable direction be issued upon the authority to take into consideration and decide the same in accordance with law.

In view of the said submission, the Court is inclined to accept the request of the petitioner. As a result of this, this petition is permitted to be withdrawn with a direction that the petitioner shall produce copy of the order of this Court before the competent authority and as and when such order is placed, the competent authority shall examine the grievance of the petitioner and shall take appropriate decision in accordance with law on the pending

application dated 7.10.2020 and decide the same after due compliance of the principles of natural justice within a period FOUR WEEKS from the date of placement of this order by the petitioner.

It is clarified that the Court has not examined the merit of the contentions and it is independently left it open for the authority to consider the request of the petitioner in accordance with law and while deciding the same, any judgment, if produced by the petitioner, may also be taken into consideration by the authority.

With the aforesaid observation(s), the petition stands DISPOSED OF as withdrawn.
