[1] Rule. Learned Additional Public Prosecutor waives service of rule on behalf of respondent – State.

[2] The present application has been filed by the Applicant through jail for temporary bail on the ground of his father's treatment, who is suffering from paralysis.

[3] Learned APP appearing on behalf of the respondent - State through video conferencing submits that the applicant filed an application for temporary bail before the learned trial Court which came to be rejected by the learned trial Court holding the seriousness of offence.

[4] Having heard learned APP for the respondent State and perused the jail remarks as well as taking into consideration that (i) the applicant is in jail for about 1 year; (ii) the applicant is required to look after his ailing father and take care of his family; (iii) the applicant has not enjoyed any such release; (iv) looking to the present situation as

trial is stalled, this Court is of the opinion that the application requires consideration and the same is allowed. The applicant shall be released on temporary bail for a period of 30 days from the date of his actual release, on executing personal bond of Rs.5,000/- (Rupees five thousands) before the Jail authority and on usual terms and conditions. The applicant to surrender before Jail Authority on completion of temporary bail, without fail. Rule is made absolute to the aforesaid extent.
