Heard Mr.Rachh, learned advocate for the applicant and Ms.Mehta, learned APP for the respondent – State through Video Conferencing.

Learned advocate for the applicant has submitted that earlier when the matter was listed before the another Bench, it was suggested that whether the trial Court was concluded or not and how many witnesses have been examined. Thereupon, he has submitted that out of 26 witnesses, 17 witnesses have been examined by the Trial Court before lock down and, therefore, necessary direction may be issued to the Trial Court to decide and dispose of the case at the earliest.

Learned APP has submitted that without entering into

the merits of the case, let the Trial Court may be directed to expedite the hearing of the trial.

In view of consensus between the learned advocates for the parties without entering into the merits of the case, this Court is of the considered opinion that if the Trial Court is directed to examine remaining witnesses and to dispose of the case in time bound manner, it will meet the interest of justice.

In view of the above, the Trial Court is directed to see to it that the case is decided, as expeditiously as possible, preferably within a period of three months from the date of receipt of the writ of this order. Let the Trial Court be informed accordingly.

In case, if the case is not decided in time bound matter, the applicant may approach the appropriate Court for bail.

The present application stands disposed of accordingly.
