Learned advocate Mr. S.P. Majmudar for the petitioner states that the respondent no.2 has passed an order in Case No.C-87/2009/DGIR on 15.01.2019 and penalty of Rs.32,724/is imposed upon association. He further submitted that in the said order no penalty or any other proceedings are initiated against the petitioners. He has tendered a copy of the aforesaid order which is ordered to be taken on record.

no.2, under instructions, states that the respondent no.2 is not to take any action pursuant to impugned order dated 13.03.2012 issued directing the petitioner to submit their personal balance-sheet and profit and loss account and in view of the aforesaid final order being passed.

In view of the aforesaid subsequent development in the matter, learned advocate for the petitioner seeks permission to withdraw this petition, more particularly, in view of the statement made by learned advocate for the respondents, as no grievence of the petitioner would survive.

Without entering into merits of the case, permission as prayed for is granted. The petition stands disposed of accordingly.
