Consistently, learned Advocate for the petitioners has remained absent and the same is also recorded in several orders passed by this Court.

Today, when the matter is called out, learned Advocate for the petitioners is absent whereas the respondent No.3 who appears as a party-in-person being a lawyer is present.

The present petition is filed essentially with a prayer to defreeze the bank accounts of the petitioner Trust. According to the petitioners, the directions are for defreezing the account/s which are on account of the orders passed by the Charity Commissioner at various points of time.

The respondent No.3 submits that the petitioners have amongst themselves decided to comply with the directions issued from time to time by the Charity Commissioner for the purpose of administration of the Trust and since they are now willing, the respondent No.3 is agreeable if the petitioners are to administer the Trust as per the directions issued by the Charity Commissioner from time to time.

Considering the scope of the present petition, the submission made by respondent No.3 may not be of any consequence as the relief prayed for pertains to defreezing of the accounts.

In absence of the petitioners and the orders being of 2013, the Court is not inclined to entertain the petition only on the ground of lapse of period.

In view of the above, the petition stands dismissed. Notice is discharged.
