[1.0] Present application under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as “CrPC”) has been preferred by the applicants herein – original accused to quash and set aside the impugned FIR being I-CR No.21/2010 registered with Ranpur Police Station, Ahmedabad (Rural) for the offences punishable under Section 306 and 114 of the Indian Penal Code, 1860 (hereinafter referred to as

[2.0] Today, when the present application is taken up for final hearing, Shri Hriday Buch, learned advocate appearing on behalf of the applicants has stated at the Bar that after conclusion of the investigation, the Investigating Officer has submitted ‘A’ Summary before the learned Magistrate and the same is pending consideration before the learned Magistrate. In view of the above, he seeks permission to withdraw the present application.

[3.0] Permission is, accordingly, granted. Present application is dismissed as withdrawn without further entering into the merits of the case and/or expressing anything on merits in favour of either parties. Rule is discharged. Ad-interim relief granted earlier stands vacated forthwith.
