Heard Mr. S. Islam, learned counsel appearing for the petitioner. Also heard Ms. U. Nanda, learned counsel appearing on behalf of Mr. S. C. Biswas, learned counsel for the respondent Nos. 4 and 5.

Ms. U. Nanda, learned counsel appearing for respondent Nos. 4 and 5, has placed before this Court a communication dated 30.04.2026 received from the Office of the Divisional Security Commissioner, N.F. Railway, informing that during the pendency of the present writ petition, the petitioner, namely, Bijoy Kumar Singh, expired on 01.03.2025. Along with the said communication, a copy of the death certificate dated 08.07.2025 issued by the Gram Panchayat Pokharia, Department of Health and Family Welfare, Government of West Bengal, has also been furnished. The said communication is taken on record and marked as Exhibit “X”.

On the previous date, i.e., 03.06.2026, this Court had adjourned the matter to enable the learned counsel for the petitioner to obtain instructions as to whether the petitioner was desirous of pursuing the

writ petition. However, in view of the subsequent information regarding the demise of the petitioner and in the absence of any instructions regarding substitution of his legal heirs or any person interested in prosecuting the proceeding, no further steps have been taken in that regard.
