The instant application has been filed by the wife of Late Kaohai, who is the respondent in I.A.(C)/251/2025 and I.A.(Civil)/252/2025 arising out of WA/49/2025.

2. Heard learned counsel for the applicant, Ms. Obangnenla Longchar.

4. It is submitted by the learned counsel that the instant application is being filed for representation of the respondent, Late Kaohai, through his legal heir, Smti. Tongphe, who is the wife of Late Kaohai, respondent, in I.A.(C)/251/2025, I.A.(Civil)/252/2025 and WA/49/2025.

5. It is stated that the respondent, Late Kaohai had filed WP(C)/145/2024 praying for pension and retirement benefits; however, during the pendency of the writ petition, the respondent/petitioner expired on 29.12.2024, leaving behind his legal heirs, including his wife, who is the present applicant.

6. It is stated that the respondent’s counsel was intimated about the demise of the respondent, Late Kaohai only after the disposal of the WP(C)/145/2024, by Order dated 21.01.2025. Accordingly, the applicant has obtained the Succession Certificate bearing Succession Case No. 39/2025 from the Principal District Judge Tuensang, Nagaland. It is also stated that the notice of the Order of this Court in WP(C)/145/2024 was served to all the opposite parties/appellants on 15.04.2025, along with the Death Certificate, dated 29.12.2024, of the late petitioner/respondent and the Succession Certificate obtained by the applicant.

7. It is, therefore, prayed that the application may be allowed and the respondent, Late Kaohai may be allowed to be represented by his wife, Legal heir, Smti. Tongphe in I.A.(C)/251/2025, I.A.(Civil)/252/2025 and WA/49/2025.

8. We have gone through the pleadings and the connected documents which are annexed and accordingly, the present application is allowed. The late respondent is allowed to be represented by his legal heir/wife, Smti. Tongphe in all the applications and the writ appeal as prayed for.
