Heard Mr. D. Talukdar, learned Senior Counsel, assisted by Mr. P. Saikia, learned counsel appearing for the accused-applicant. Also heard Mr. P.S. Lahkar, learned Addl. P.P., appearing for the State respondent.

2. This is an application, filed under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant in connection with Dispur P.S. Case No. 192/2026, registered under Sections 109/118(2)/3(5) of the BNS, 2023.

The facts narrated in the FIR dated 04.04.2026, lodged by one Harinarayan Das that on 04.04.2026, while the accused-applicant and Sukumar Sarma were consuming alcohol at the mentioned place in the FIR, they assaulted one Luhit Medhi and Hridoy Das with alcohol bottles as a result of which they sustained injuries and had to be admitted in the hospital.

4. This Court, vide order dated 08.04.2026, had given interim relief to the accused-applicant with the direction to cooperate with the investigation.

5. Case Diary in the instant case was called for. However, though sufficient time has elapsed, the Case Diary is not produced today also when the matter was called for.

6. Mr. D. Talukdar, learned Senior Counsel submits that the main accused, namely, Sukumar Sarma has already been granted bail by the learned Addl. Sessions’ Judge (FTC) No. 4, Kamrup (M), Guwahati, vide it’s order dated 22.05.2026. He further submits that the accused-applicant is a law abiding citizen and he was, in fact, not involved in the alleged incident that has been narrated in the FIR. He submits that in terms of the order dated 08.04.2026, the accusedapplicant has already appeared before the Investigating Officer and got his statement recorded. He submits that taking into account his conduct, his interim bail should be made absolute at this stage.

7. Mr. P.S. Lahkar, learned Addl. P.P., on the other hand, submits that Case Diary is required in the instant matter and without perusing the Case Diary, this Court should not allow the accused-applicant to go on bail.

This Court has heard the submissions made by the learned counsel appearing for the respective parties and after perusal of the materials brought on record is of the considered opinion that the interim bail order passed on 08.04.2026 should be made absolute at this stage. Accordingly, the interim bail granted to the accusedapplicant on 08.04.2026 is made absolute in the same terms and conditions as mentioned therein.

9. In the above terms, the instant bail application is disposed of as allowed.
