Heard Mr. J. Hatimuria, learned counsel for the petitioner, who submits that the case of the petitioner for compassionate appointment was considered by the District Level Committee (DLC) Lakhimpur which held its meeting on 26.10.2023 and the petitioner was recommended for appointment to the post of Upper Primary Teacher under the Office of the District Elementary Education Officer, Lakhimpur in terms of the earlier writ petition filed by the petitioner i.e., WP(C)/2851/2023 which was disposed of vide order dated 08.09.2023. The name of the petitioner appears at Sl. No. 7 of the DLC minutes. The learned counsel submits that the DLC minutes was forwarded to the Commissioner and Secretary to the Govt. of Assam Department of School Education by the District Commissioner, Lakhimpur on 04.11.2023 but due to the Office Memorandum dated 18.09.2024, the case of the petitioner has not been considered till date.

The learned counsel submits that similarly situated persons with similar grievances had approached this Court and this Court vide common order dated 03.04.2025 with the lead case being WP(C)/342/2025 had disposed of the writ petitions by directing the respondent authorities to place the case of the petitioner therein before the State Level Committee for consideration in terms of the policy of the State Government on compassionate appointment. The learned

counsel submits that the case of the petitioner is also squarely covered by the said direction and a similar relief may be granted.

Ms. K. Phukan, learned Govt. Advocate submits that in terms of the direction of this Court dated 03.04.2025, the Government of Assam in the Personnel Department have issued a notice on 30.08.2025 asking all similarly situated persons should submit their testimonials and other relevant documents on or before 15.09.2025 for consideration. Therefore, submits that the petitioner may also do the same.

In view of above, the writ petition is disposed of by directing the respondent authorities to place the case of the petitioner before the next SLC and the petitioner shall submit all the requisite testimonials and materials in terms of the Notice dated 30.08.2025 to facilitate the respondents to consider her case.

Writ petition is accordingly stands disposed of.
