This is an application under Section 483 of BNSS, praying for granting bail to the accused Arif Islam, who was arrested on 08.04.2024 in connection with Banderdewa Police Station Case No. 32/2024, U/s 21 (b) of the Narcotic Drugs and Psychotropic Substance (NDPS in short), 1985 arising out of FIR dated 08.04.2024.

2. Learned counsel for the petitioner’s states that, accused was arrested

on 08.04.2024 and thereafter, he had filed the first bail application being BA No. 439 of 2024 which was rejected by the learned Special Judge (NDPS), Yupia vide order dated 03.12.2024.

It is stated that a subsequent bail application was moved before the same court which was registered as bail application No. 457/2024 and accordingly, the hearing on bail application was taken up on 12.02.2024. It is contented by the learned counsel for petitioner, Mr. Minjum Kancham that the learned Special Judge (NDPS) Yupia has not disposed of the said bail application 457/2024 and no order has been passed till date. Hence, the present application is before this Court.

4. Learned Public Prosecutor. Mr. D. Loyi is present for the State of Arunachal Pradesh and he has contended that the learned Special Court (NDPS) may be directed to dispose of the bail matter 457/2024, which is pending before the learned Trial Court.

This Court has observed that the petitioner has annexed a copy of the certified true copy application before the learned Special Judge(NDPS) Yupia dated 12.02.2025, through which he had applied for a copy of the order passed in bail application 457/2024. However, it was found out that no order had been passed and the bail application 457/2024 had not been disposed of.

6. Accordingly, this petition is disposed of with a direction to the learned Special Judge(NDPS), Yupia to pass necessary orders in connection with bail application 457/2024, expeditiously.
