1. Heard Mr. G. Chamuah, learned counsel for the petitioner. Also heard Ms. N. Das, learned Additional Public Prosecutor for the State of Assam.

2. This is a second bail application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Silapathar P. S. Case No.123/2025.

3. Earlier, the bail application of the petitioner was rejected on 25.06.2025, vide

Bail Application No.1947/2025, today no new ground has been pleaded.

4. Learned counsel for the petitioner has submitted that the investigation of the case has proceeded to a greater extent and, therefore, the petitioner need not be detained in custody.

5. I have considered the submissions made by learned counsel for both the sides.

6. Once the bail application is rejected, the petitioner has to show a new ground in the subsequent bail application but, no new ground has been pleaded.

7. According to the learned counsel for the petitioner, one of the accused petitioner was released on bail by the learned Sessions Judge, Dhemaji.

¶24

8. Therefore, the petitioner is directed to approach the Sessions Court at Dhemaji for seeking bail. The learned Sessions Judge shall consider his bail application without being influenced by any order passed by this Court.

9. With the aforesaid direction, the bail application stands closed and disposed of.
