Heard Mr. Z. Khalid, learned counsel for the petitioners, who submits that the petitioners are running a bus stand in Nagaon Town for the last 30 years. However, the Government is planning to shift the bus stand to a place, which is outside the municipality area of the Nagon Municipal Corporation.

The petitioners’ counsel submits that till land is allotted for the proposed new bus stand, the petitioners should be allowed to run their business from the existing bus stand. The petitioners’ counsel submits that though the petitioners had submitted various representations, the latest one being 22.01.2024, the Deputy Commissioner, Nagaon has not considered the said representation. He submits that the writ petition can be closed, if a direction is issued to the Deputy Commissioner, Nagaon, to take decision on the petitioners’ representation.

Ms. M. D. Bora, learned counsel for the State respondent Nos. 1, 2 & 5 and Mr. G. Bakalial, learned counsel for the respondent Nos. 3 & 4 submit that they have got no objection to the prayer made by the petitioners’ counsel.

In view of the consent of the parties, the Deputy Commissioner, Nagaon is directed to take a decision on the petitioners’ representation dated 22.01.2024 and thereafter communicate the same to the petitioners. The

exercise should be concluded within a period of 2 (two) months from the date of receipt of a copy of this order along with a copy of the writ petition. The copy of this order should be submitted to the Deputy District Commissioner, Nagaon, within one week from today.

This writ petition is accordingly disposed of.
