Mr. B. Choudhury, the learned Standing counsel appearing on behalf of the APDCL has placed before this Court a communication issued by the Chief General Manager (PP&D), APDCL to the effect that the tender which have been assailed in the instant proceedings i.e. for execution of the work of “Construction of New 33 KV line from 132/33 KV Gopigaon, Bilasipara, GSS to 33/11 KV Sapatgram SS & 11 KV extension line for Sapatgram 11 KV Town Feeder upto Nandipara (Package-II) would be withdrawn and fresh tender would be issued. The said communication which was placed before this Court is kept on record and marked with the letter “X”.

Mr. M. Dewan, the learned counsel appearing on behalf of the Petitioners submitted that in view of the decision so taken by the APDCL Authorities to cancel the earlier tender process and to float a fresh tender process, he would not like to press the instant writ petition. Accordingly, the instant writ petition therefore stands closed in view of the communication kept on record and marked with the letter “X”.

In view of the withdrawal of the instant writ petition, the Respondents are given the liberty to float a fresh tender in respect to the above mentioned work.

Interim order passed earlier stands vacated.
