Mr. Bam, learned counsel for the petitioners submits that since the petitioners are members of the same family being husband, wife and the father, they during the pendency of the case have amicably settled the matter and executed a Deed of Agreement on 15.07.2024. As per the Deed of Agreement dated 15.07.2024, the parties have mutually reconciled and settled the misunderstanding amongst them with a view to live a peaceful family life. As such, the informant and the victim have agreed to withdraw the case pending against the petitioner No.1 before the learned Court of Chief Judicial Magistrate, Aalo. It is further submitted that since the victim and the informant have no further grievance against the accused/petitioner No.1, they have agreed to cooperate for withdraw of the case against him. However, since one of the offences involved in the case is non-compoundable offence, especially section 498-A and the same is beyond the power of the learned Court of Chief Judicial Magistrate, the petitioners have filed the present petition under Section 482 of the Cr.P.C with a prayer for compounding of the case.
