Heard Mr. S Roy, learned counsel for the petitioner and Mr. R J Baruah, learned Additional Public Prosecutor, Assam for the opposite party No. 1. Also heard Ms. R Choudhury, learned counsel for the opposite party No. 2.
Aggrieved by the judgment and order dated 06.12.2022 passed by the learned Sessions Judge, Karimganj in Criminal Revision No. 38/2021 upholding the ex-parte order dated 28.11.2019 directing to pay monthly maintenance of Rs.3000/- to the opposite party No. 2 and Rs.2000/- each to her children, the petitioner has filed this criminal petition praying amongst others for setting aside and quashing the said judgment and order dated 06.12.2022 passed by the learned Sessions Judge, Karimganj.
During the deliberation of the matter, on instruction of the petitioner, Mr. Roy, learned counsel submitted that the petitioner is not pressing this criminal petition.
Accordingly, this criminal petition stands dismissed, being not pressed.
Registry shall return the record of Misc. Case No. 617 (DV)/2018 to the Court of learned Chief Judicial Magistrate, Karimganj that was earlier called for by order dated 24.07.2022 along with a copy of this order.
