Heard Mr. R.C. Das, learned counsel for the applicant and Mr. A.R. Das, learned counsel, appearing on behalf of Mr. R.C. Paul, learned counsel for the respondent No. 3.

By order dated 13.03.2023 passed by this Court in MAC Appeal No. 110/2017, it was ordered that the names of the respondent Nos. 2 and 3 be stuck off from the memo of the appeal.

Mr. R.C. Das, learned counsel however by filing the present application submits that the participation of respondent Nos. 2 and 3 is necessary for the disposal of the appeal and therefore, the order dated 13.03.2023 passed in the appeal may be recalled. The learned counsel for the opposite party has no objection.

In view of the submission made by the learned counsel for the parties, the order dated 13.03.2023 passed in MAC Appeal No. 110/2017 in so far as it relates to the striking of the names of the respondent Nos. 2 and 3 is recalled and the respondent Nos. 2 and 3 are allowed to contest the appeal as party respondent.
