Heard Mr. A. Barua, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State respondent.

This is an application under Section 439 of the Code of Criminal Procedure, 1973, praying for grant of pre-arrest bail to the accused/petitioner, Sri Nilam Das @ Domai who is apprehending arrest in connection with Tezpur P.S. Case No.989/2023 under Sections 325/364(A)/34 IPC.

Case diary is received. Perused the same.

It is submitted by the learned counsel for the petitioner that the accused was granted interim bail on 12.01.2024 by this Court for Rs.30,000/- with one surety of the like amount to the satisfaction of learned CJM, Sonitpur, Tezpur. Accordingly, his bail bond was accepted by the CJM.

It is submitted by the learned counsel for the petitioner that the petitioner is a student of Bachelor of Computer Application and he will appear before the I/O if his cooperation is needed in connection with this case.

In this context, learned Additional Public Prosecutor has submitted that his statement is also recorded by the I/O and the injury report is also available.

After hearing the submissions of the learned counsel for both sides and also the materials available in the case diary along with the injury report, I find that further custodial interrogation may not be necessary in this case.

Accordingly, the interim bail order dated 12.01.2024 is hereby made absolute with the same terms and conditions.
