Mr. G.,D Dhiman, petitioner-in-person is present. And Mr. B. Chakravarty, learned GCG for the respondent is also present.
Pursuant to the earlier order dated 16.08.2024, the learned Arbitrator proposed by the petitioner Shri Bani Kanta Das, Advocate and former Chief Engineer and Secretary to the Government of Assam, PWD has furnished the prescribed disclosure in writing as required under Section 11(8) read with Section 12 of the Arbitration and Conciliation Act, 1996. The proposed learned Arbitrator in his communication dated 05.09.2024 has disclosed that there is no hindrance for the learned Arbitrator to undertake the present arbitration if appointed so by the Court. Copy of the disclosure communication dated 05.09.2024 addressed to the petitioner-in-person under Section 12(1) of the Arbitration and Conciliation Act will be signed by the learned Arbitrator is kept on the record.
In view of the discloser furnished expressing no difficulty in undertaking the arbitration, this Court appoints Shri Bani Kanta Das, Advocate from the list of panel published by the Gauhati High Court vide Notification No. 29 dated 21.05.2024 as an Arbitrator to decide the disputes arising between the petitioner and the respondent department in connection with GE/AF/TEZ/16 of 2013-2014 relating to periodical services to (internal) certain buildings at AF Stn under GE (AF), Tezpur. Copy of this order will be placed before the Arbitrator appointed and the parties will appear before the Arbitrator on 28.10.2024.
The arbitration petition is accordingly disposed of in terms of the above.
