Heard Mr. A.M. Barbhuiya, learned counsel for the petitioner and Ms. M. Barman, learned Junior Government Advocate, Assam for all the respondents.
Ms. Barman, learned Junior Government Advocate has placed a communication bearing no. HKD/CR/23/703 of the Superintendent of Police, Hailakandi. From the said communication, it transpires that pursuant to the order dated 26.10.2022, passed by the learned Munisff no. 1-cum-Judicial Magistrate First Class, Hailakandi in complaint case, C.R. Case no. 1057/2022, a case has already been registered by the Officer In-Charge, Hailakandi Police Station vide Hailakandi Police Station Case no. 32/2023 under Sections 447/294/506/427/323/307/120B/379/34, Indian Penal Code r/w Section 27, Arms Act, 1959, and the case is now under investigation.
In view of the registration of Hailakandi Police Station Case no. 32/2023, the Court is of the view that the grievance raised by the petitioner in this writ petition has been effectively redressed and there is no live issue to proceed further with the writ petition.
Accordingly, the writ petition is closed.
