Heard Mr. R. Saikia, learned counsel for the petitioner and also heard Ms. K. Wangmo, learned Government Advocate for the respondents.
The challenge in this writ petition is an eviction order dated 15.02.2021 passed by the Estate Officer, Itanagar. Vide order dated 26.11.2020 first eviction order was issued against which the petitioner has preferred an appeal before the Deputy Commissioner, Itanagar Capital Complex, Itanagar and the same was stayed by the Deputy Commissioner vide order dated 15.12.2020. Despite such stay of the first eviction order, the Estate Officer issued another eviction order dated 15.02.2021 against which the petitioner is aggrieved of. When the matter was listed before this Court on 14.06.2023, this Court has directed the learned Government Advocate to obtain the complete instructions on the next date regarding the status of the matter.
Today, Ms. K. Wangmo, learned Government Advocate has produced the letter dated 15-06-2023 issued by the Deputy Commissioner, Itanagar Capital Complex, Itanagar whereby it clearly states that the construction of CC Pavement “Road from NH-415 Ganga Market to ESS Tri-Junction near Minister Bungalow No. 1 to SP Office Itanagar has been completed and no further eviction is required.
In view of the above, and as agreed to by the learned counsel for the parties, the writ petition is closed and disposed of as being infructuous. The
