Heard Mr. A. Narzari, learned counsel for the petitioner, who submits that the petitioner is the owner of land measuring 13 Bighas 03 Kathas 15 Lechas covered by Dag No. 298 of Periodic Patta No. 253 of Village Dangagaon under Sidli Revenue Circle in the District of Chirang, B.T.R., Assam.

The petitioner’s grievance is that the Kajalgaon Municipal Board, Kajalgaon, B.T.C., Chirang has issued Tender Notice dated 02.02.2023, for running the

Kajalgaon Weekly Chowk Bazar (every Sunday) on the land of the petitioner.

The petitioner’s counsel submits that the petitioner has submitted a representation against the said Tender Notice dated 02.02.2023, vide Representation dated 24.02.2023. However, the petitioner’s representation has not been decided by the respondent No. 7 till date.

Mr. S. Borah, learned counsel for the respondent Nos. 2 & 3 submits that there is nothing to show in the Tender Notice dated 02.02.2023 that the land of the petitioner is going to be used for the Kajalgaon Weekly Chowk Bazar. He however submits that the issue can be decided by the respondent No. 7.

In view of the consent of the parties, the respondent No. 7 is directed to take a decision on the petitioner’s Representation dated 24.02.2023 within 10 (ten) days from today.

Till a decision is taken by the respondent No. 7, the Tender Notice dated 02.02.2023 should not be acted upon. The above directions are however subject to the condition that the petitioner shall submit a copy of this order to the respondent No. 7 within 3 (three) days from today.

The writ petition is accordingly disposed of.
