Shri Dev Nath, learned Standing Counsel, P&RD however submits that there is no infirmity or illegality in the said notice. Shri Dutta however fairly submits that the time granted to vacate may not be reasonable and as such a reasonable time frame may be given by this Court. After hearing the parties and on perusal of the records, this Court is of the opinion that no fruitful purpose would be served by keeping this writ petition pending. Accordingly, the same is disposed of on the motion stage itself by holding that the period given to the petitioners to vacate the rooms be extended to that of 1 month from today. For the sake of clarity the deadline is fixed on 09.04.2023. It is however directed that prior to the said date and preferably within a period of 2 (two) weeks from today i.e. within 24.03.2023, the Memorandum of Understanding, as revealed in the notice dated 20.02.2023 be executed in which there would be a condition to re-allot suitable room to the petitioners upon completion of the construction of the new three storied building.
